(A) The Common Council, upon receiving a special written request at a regular meeting of the Council may except any overhead or above ground extensions to the utility operating system provided the extension will be placed underground within two years and a performance bond determined by the Council is filed.

(B) If the overhead system to be constructed is to operate in a voltage range or class above 20 KV, then such construction is exempted from this subchapter, provided the construction is performed under the latest recommended designs for such range and voltage.
