(A) Any persons violating the terms of this chapter shall be subject to a fine not exceeding $100 or cost of prosecution, or both fine and costs.
(B) Costs of prosecution shall be the actual costs of the proceeding, including but not limited to attorney fees, witness fees actually expended, and wages of law enforcement officers related to such capture and prosecution.
