§ 150.40 PERMIT FEES.
   (A)   General fees. The city shall establish the following fees.
      (1)   Excavation permit fee. The city shall establish an excavation permit fee in an amount sufficient to recover the following costs:
         (a)   The city management costs; and
         (b)   Degradation costs, if applicable.
      (2)   Obstruction permit fee. The city shall establish an obstruction permit fee that shall be in an amount sufficient to recover the city management costs.
      (3)   Payment of permit fees. No excavation or obstruction permit shall be issued without payment of the excavation or obstruction permit fees. The city may allow an applicant to pay such fees within 30 days of billing.
      (4)   Non-refundable. Permit fees that were paid for a permit that the city has revoked for breach as stated in herein are not refundable.
      (5)   Application to franchises. Unless otherwise agreed to in a franchise agreement, management costs may be charged separately from and in addition to the franchise fees imposed on a franchise right-of-way user as permitted in Title XI of this code.
      (6)   State regulations. All permit fees shall be established consistent with the provisions of Minn. Rules Part 7819.1000.
   (B)   Permit fee exception; expiration.
      (1)   Exception. Permit fees are based on valuation using the fee schedule found in the city’s fee schedule located in the Clerk’s Office.
      (2)   Expiration.
         (a)   Every permit issued by the Building Official shall expire by limitation and become null and void if the building or work authorized by such permit is not commenced within 180 days from the date of such permit, or if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for 180 days. Before such work can be recommenced, a new permit shall be first obtained to do so, and the fee therefor shall be one-half the amount required for a new permit for such work, excluding plan review fee, provided no changes have been made or will be made in the original plans and specifications for such work.
         (b)   The Building Official may grant, in writing, one or more extensions of time for periods not more than 180 days each. The extension shall be requested in writing and justifiable cause demonstrated.
      (3)   Expiration of plan review. Applications for which no permit is issued within 180 days following the date of application shall expire by limitation, and plans and other data submitted for review may thereafter be returned to the applicant or destroyed by the Building Official. In order to renew action on an application after expiration, the applicant shall resubmit plans and pay a new plan review fee. In the event of a hardship, and at the discretion of the Building Official, a new plan review fee may be waived.
   (C)   Building permit fees. Building permit fees shall be found in the city’s fee schedule.
