(A) The definitions included in M.S. § 237.162, as it may be amended from time to time, Minn. Rules Part 7819.0100, Subp. 1 through 23, and Minn. Rules Part 7560.0100, Subp. 1 through 12 are hereby adopted by reference and are incorporated into this section as if set out in full.
(B) For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
DEGRADATION. A decrease in the useful life of public property caused by excavation in or disturbance of public property, resulting in the need to reconstruct such public property earlier than would be required if the excavation or disturbance did not occur.
DELAY PENALTY. The penalty imposed as a result of unreasonable delays in public property excavation, obstruction, patching, or restoration as established by permit.
EMERGENCY. A condition that:
(a) Poses a danger to life or health, or of a significant loss of property; or
(b) Requires immediate repair or replacement of facilities in order to restore service to a customer.
EXCAVATE. To dig into or in any way remove or physically disturb or penetrate any part of public property.
OBSTRUCT. To place any tangible object in or on public property so as to hinder free and open passage over that or any part of public property.
PUBLIC PROPERTY. Any existing public systems, including storm water, sewer, water, street, sidewalk, boulevard, park, beach, open space, wetlands, shorelands, and other related public works or park systems and public right-of-way.
RESTORATION COST. The amount of money paid to the city by a permittee to achieve the level of restoration according to plates 1 to 13 of the state’s Public Utilities Commission rules.
