§ 70.45 WINTER PARKING.
   (A)   Time limitations. It shall be unlawful for any person to park, to leave unattended, whether the engine is running or not, any motor vehicle, trailer, or conveyance on any street, avenue, or alley in the city between the hours of 2:00 a.m. and 7:00 a.m. during the dates of November 1 through March 31 in any year.
   (B)   Towing authorized. Any motor vehicle, trailer, or conveyance parked in violation of any of the provisions of this section shall be towed away at the expense of the owner of the vehicle, trailer, or conveyance, except when the owner of the vehicle requests and receives the hardship exception provided in division (C) below. Such vehicle, trailer, or conveyance shall not be released until the towing and storage fees are paid, in addition to any fine imposed for violation of this section.
   (C)   Hardship exception.
      (1)   Authorized. Any person who does not own or lease enough lot area to possess off-street parking for his or her vehicle may provide for the moving of his or her own vehicle or guest vehicle as long as he or she furnishes a written request to the City Clerk-Treasurer in the form provided by the city.
      (2)   Form of request. The requesting party shall state his or her name, circumstances, address, home phone number, permission for city crew to call in early morning hours, and statement to the effect that the person will move his or her vehicle or the vehicle of the guest upon being telephoned by city crew or Police Department when it snows. Upon receiving written request, the Police Department will inquire into the circumstances to verify that a hardship exists.
