§ 174.22  UNLICENSED OR INOPERATIVE MOTOR VEHICLES AND PARTS.
   (A)   Definitions.  For the purposes of this section, the words and phrases defined hereunder shall have the meanings respectively described to them.
      MOTOR VEHICLES IN AN UNLICENSED OR INOPERATIVE CONDITION.  Any style or type of motor driven vehicle used or useful for the conveyance of persons or property which is unlicensed or unable to move under its own power due to defective or missing parts and has remained in such condition for a period of not less than 30 consecutive days.
      MOTOR VEHICLE PARTS.  Any portion or part of any motor driven vehicle as detached from the vehicle as a whole.
      MOTOR VEHICLE UNFIT FOR FURTHER USE.  Any style or type of motor driven vehicle used for conveyance of person or property which is in the dangerous condition defective or missing parts or is in such a condition generally as to be unfit for further use as a conveyance.
   (B)   Nuisance declared.
      (1)   It shall be unlawful and deemed a nuisance for any owner or occupant or other person or entity with control of a property to store, place, or allow to remain any motor vehicles in an unlicensed or inoperative condition, motor vehicle unfit for further use, or motor vehicle parts on a property, not in an enclosed building or structure on land or premises within the boundaries of the Village of Cridersville.
      (2)   It shall be the duty of any owner or occupant or other person or entity with control of the property to cause such motor vehicles in an unlicensed or inoperative condition, motor vehicle unfit for further use, or motor vehicle parts to be removed from their premises and properly disposed of.
   (C)   Notice of violation.
      (1)   Upon information that motor vehicles in an unlicensed or inoperative condition, motor vehicle unfit for further use, or motor vehicle parts is present on lands or premises within the boundaries of the Village of Cridersville and upon a finding by the Village Council that motor vehicles in an unlicensed or inoperative condition, motor vehicle unfit for further use, or motor vehicle parts is present on lands or premises within the village, and has not been removed, the Village Council shall cause a written notice to be served upon the owner or occupant or other person or entity having control of said land pursuant to section (C)(2) below.
      (2)   Notice shall be in writing and given to an owner or occupant or other person or entity having control of the land located within the Village of Cridersville by the Village Chief of Police or their designee to immediately collect and remove the motor vehicles in an unlicensed or inoperative condition, motor vehicle unfit for further use, or motor vehicle parts.  Such notice shall be in writing, delivered by registered or certified mail, personally, or by posting to the land where the violation occurred.  Should the address of the record owner be unknown and the premises be unoccupied it shall be sufficient to publish the notice once in a newspaper of general circulation within Auglaize County, Ohio.  The owner or occupant shall remove the offending motor vehicles in an unlicensed or inoperative condition, motor vehicle unfit for further use, or motor vehicle parts within 15 days of receipt of notice or of publication, whichever is applicable.
   (D)   Penalty.  If the owner, occupant, or other person or entity having control of such land fail to comply with notice as served pursuant to divisions (C)(1) and (2) above within the 15 days such owner, occupant, or person or entity having control of the land may be issued a citation by the village and fined up to $100.  Each failure to abide by an order issued under this section shall be deemed a separate violation.
