§ 174.60  NOISE LIMITATIONS.
   (A)   (1)   No person shall operate or permit the operation or playing of any radio, television, phonograph, musical instrument, loudspeaker, music or voice reproduction device, or similar device which produces, reproduces or amplifies sound:
         (a)   In such a manner as to create a noise disturbance across a boundary of property;
         (b)   In such a manner as to create a noise disturbance when operated in or about a motor vehicle on a public right-of-way or at a public place; or
         (c)   In such a manner as to create a noise disturbance in or at a public place.
      (2)   For the purpose of this section, a NOISE DISTURBANCE is defined as any unreasonably loud, raucous, disturbing or unnecessary noise, or any noise of such character, intensity or duration as to disturb the peace, quiet, good order of the village or which is likely to be detrimental to or cause inconvenience or annoyance to a person of ordinary sensibilities, or any other noise or sound created in such a manner as to disturb the peace and quiet of a neighborhood or residents of the village, or alternatively as a sound pressure level of 65 decibel C scale, fast meter as measure on an ANSI S 1.4 Type 2 Sound Pressure Level Meter that is calibrated within 6 hours of the measurement, the measurement having been made at a distance of 50 feet or greater from the noise source, or at the real property line. ANSI S 1.1-Terminology and ANSI 1.4-Sound Level Meters are hereby adopted as part of this section.
   (B)   This section shall not apply to functions specifically permitted by the Ohio Revised Code or other village ordinances or resolutions. It shall also not apply to public functions for which a permit has been issued by the village.
   (C)   Penalty. Any person who is found guilty of a violation of this section shall be guilty of a minor misdemeanor offense, punishable by a fine of no more than $150.
