(A) No tavern, dramshop or place where alcoholic liquor is sold or kept for sale shall locate (except those locations now established) or relocate within one hundred feet (100') of any church, school other than an institution of higher learning, hospital, home for aged or indigent persons or for veterans, their spouses or children, military or naval station, mortuary, or undertaking establishment. Nothing herein shall affect those locations now established as or operated as a tavern or dramshop unless such locations are abandoned in favor of another business.
(B) No tavern, dramshop or place where alcoholic liquor is sold or kept for sale shall locate or relocate at any place of business where the majority of customers are minors of school age or where the principal business transacted consists of school books, school supplies, food, or school lunches or drinks for such minors.
(C) Whenever in this chapter, a licensed premises is required to be located a specific distance from a church, the distance shall be measured from the lot line or property line of the licensed premises to the nearest part of the exterior portion of the church used for worship or educational programs; provided, however, that such measurement shall not apply to an exemption granted by the Mayor as the Liquor Control Commissioner in accordance with this section.
(D) Whenever in this chapter, a licensed premises is required to be located a specific distance from school other than an institution of higher learning, hospital, home for aged or indigent persons or for veterans, their spouses or children, military or naval station, mortuary, or undertaking establishment, the distance shall be measured from the lot line or property line of the licensed premises to the lot line or property line of the applicable use identified in this sentence.
(E) Notwithstanding any provision of this chapter or this section to the contrary, the Mayor as the Local Liquor Control Commissioner may grant an exemption for the location of a tavern or dramshop within one hundred feet (100') of any church as authorized by section 6-11 of the Illinois Liquor Control Act 1 , provided that no such tavern or dramshop may be located within one hundred feet (100') of any church where such distance is measured from the main or principal entrance of the licensed premises to the main or principal entrance of the church, or in the case of a licensed premises located within a building or structure that contains multiple units, measured from the main or principal entrance of the unit in which the licensed premises is located to the main or principal entrance of the church. In order to obtain said exemption, the applicant must include a request for location exemption in the license application as required under this chapter. (Ord. 820D, 4-24-2019)
