2-10-1: CREATION, JURISDICTION, AND PURPOSE:
   (A)   The Village hereby creates a Code Hearing Department pursuant to the authority in the Illinois Municipal Code found at 65 Illinois Compiled Statutes 5/1-2.2-1 et seq., allowing the administrative adjudication of ordinance violations and 65 Illinois Compiled Statutes 5/11-31.1-1 et seq., allowing the administrative adjudication of violations of Building Code violations; as well as the authority in the Illinois Vehicle Code found at 625 Illinois Compiled Statutes 5/11-208.3, allowing the administrative adjudication of traffic regulations concerning the standing, parking, or condition of vehicles.
   (B)   1.   Except as otherwise provided in this section, the Code Hearing Department is authorized to conduct administrative adjudication of any violation of the Village Code, including ordinances that establish construction, plumbing, heating, electrical, fire prevention, sanitation, violations of zoning, or other health and safety standards that are applicable to structures in a municipality, or any Municipal ordinance that requires, after notice, the cutting of weeds, the removal of garbage and debris, the removal of inoperable motor vehicles or the abatement of nuisances from private property.
      2.   Additionally, the Code Hearing Department is authorized to conduct administrative adjudication of violations of any provision of title 9 of this Code, restricting or regulating the standing or parking of vehicles or the condition or use of equipment on a vehicle and the violation of any provision of the Illinois Compiled Statutes adopted by reference in title 9 of this Code that restricts or regulates the standing or parking of vehicles or the condition or use of equipment on a vehicle.
   (C)   Pursuant to statute, the Code Hearing Department may not conduct administrative adjudication of the following violations of the Village Code:
      1.   Any offense under the Illinois Vehicle Code or a similar offense that is a traffic regulation governing the movement of vehicles.
      2.   Any reportable offense under section 6-204 of the Illinois Vehicle Code.
   (D)   All fines imposed for any violation of village ordinances, including the Building Code and any other provision of the Village Code, shall bear interest at the rate of nine percent (9%) per annum on the unpaid balance from the date of imposition of the fine. A default in the payment of a fine and costs or any installment imposed by the circuit court or by a hearing officer may be collected by any and all means authorized for the collection of money judgements. The Village may retain attorneys and private collection agents for the purpose of collecting any default in payment of any fine or installment of that fine. The fees and costs incurred by the Village in any such collection by attorneys or private collection agents retained by the Village shall be charged to the offender, provided that the amount shall not exceed thirty-five percent (35%) of the unpaid fines and accrued interest.
