ORDINANCE NO. 847B
 
AN ORDINANCE OF THE VILLAGE OF CREVE COEUR,
TAZEWELL COUNTY, ILLINOIS, AMENDING TITLE 2, CHAPTER 10, SECTION 1, PERTAINING TO THE JURISDICTION OF CODE HEARING DEPARTMENT
 
WHEREAS, the Village Board of the Village of Creve Coeur (hereinafter “Village”) has previously adopted an ordinance establishing a Code Hearing Department pursuant to Article 1, Division 2.2 (65 ILCS 5/1-2.2-1 et seq.) for the purpose of expediting the prosecution and correction of certain code violations; and
 
WHEREAS, the Village has proposed amendments to the current Village Code in order to clarify the jurisdiction and authority of the Code Hearing Department; and
 
WHEREAS, the proposed amendments are hereinafter set forth; and
 
WHEREAS, the Village Board finds that adoption of the proposed amendments will serve the best interests of the Village of Creve Coeur and its citizens;
 
NOW, THEREFORE, BE IT ORDAINED BY THE TRUSTEES OF THE VILLAGE OF CREVE COEUR, TAZEWELL COUNTY, ILLINOIS, AS FOLLOWS:
 
Section 1 .  The recitals set forth above are found to be true and correct.
 
Section 2 .  Title 2, Chapter 10, Section 1 of the Creve Coeur Village Code is hereby amended to read as follows (additions are indicated by underline, deletions by strikeout):
2-10-1: CREATION, JURISDICTION, AND PURPOSE:
 
PursuantThe Village hereby creates a Code Hearing Department pursuant to the authority in the Illinois Municipal Code found at 65 Illinois Compiled Statutes 5/1-2.2-1 et seq., allowing the administrative adjudication of ordinance violations; as well as the authority found atand 65 Illinois Compiled Statutes 5/11-31.1-1 et seq., allowing the administrative adjudication of violations of Building Code violations; as well as the authority in the Illinois Vehicle Code found at 625 Illinois Complied Statutes 5/11-208.3, allowing the administrative adjudication of traffic regulations concerning the standing, parking, or condition of vehicles the Village hereby creates a Code Hearing Department.
 
TheExcept as otherwise provided in this Section, the Code Hearing Department is authorized to conduct administrative adjudication of the violationsany violation of the Village of Creve CoeurCode, including ordinances that establish construction, plumbing, heating, electrical, fire prevention, sanitation, violations of zoning, or other health and safety standards that are applicable to structures in a municipality. Additionally the Code Hearing Department may conduct administrative adjudication of, or any Municipal ordinance that requires, after notice, the cutting of weeds, the removal of garbage and debris, the removal of inoperable motor vehicles or the abatement of nuisances from private property.   

Additionally, the Code Hearing Department may hearis authorized to conduct administrative adjudication of violations of any provision of title 9 of this Code, restricting or regulating the standing or parking of vehicles or the condition or use of equipment on a vehicle and the violation of any provision of the Illinois Compiled Statutes adopted by reference in title 9 of this Code that restricts or regulates the standing or parking of vehicles or the condition or use of equipment on a vehicle.   
 
Pursuant to statute, the Code Hearing Department may not hearconduct administrative adjudication of the following violations of the Creve Coeur Village Code:
 
1. Any offense under the Illinois Vehicle Code or a similar offense that is a traffic regulation governing the movement of vehicles.
 
2.  Any reportable offense under section 6-204 of the Illinois Vehicle Code.
 
(D)   All fines imposed for any violation of Village ordinances, including the Building Code and any other provision of the Village Code, shall bear interest at the rate of nine percent per annum on the unpaid balance from the date of imposition of the fine. A default in the payment of a fine and costs or any installment imposed by the circuit court or by a hearing officer may be collected by any and all means authorized for the collection of money judgments. The Village may retain attorneys and private collection agents for the purpose of collecting any default in payment of any fine or installment of that fine. The fees and costs incurred by the Village in any such collection by attorneys or private collection agents retained by the Village shall be charged to the offender, provided that the amount shall not exceed 35% of the unpaid fines and accrued interest.
 
Section 2.   This ordinance is in addition to all other ordinances on the subject and shall be construed therewith excepting as that part in direct conflict with any other ordinance and, in the event of such conflict, the provisions hereof shall govern.
 
Section 3 .  This Ordinance is hereby ordered to be published in pamphlet form by the Creve Coeur Village Clerk and said Clerk is ordered to keep at least three (3) copies hereof available for public inspection in the future and in accordance with the Illinois Municipal Code.
 
Section 4 .  This Ordinance shall be in full force and effect from and after its passage, approval and ten (10) day period of publication in the manner provided by law.
