11-1-2: DEFINITIONS:
Unless otherwise expressly stated, the following words shall, for the purpose of this Title, have the meaning herein indicated. Any pertinent word or term not a part of this listing but vital to the interpretation of this Title, shall be construed to have its usual legal definition:
The present tense includes the future tense, and the future the present; the masculine gender includes the feminine gender and the neuter gender; the singular includes the plural and the plural includes the singular; and the word “shall’ is always mandatory and the word “may” is always permissive. The word “person” includes a partnership, association, firm, trust, club, institution, company or corporation as well as an individual.
ACCESS:
The word “access” shall mean the way over which traffic moves to and/or from the property abutting a street or alley and the way over which traffic moves to and/or from a major street to a minor street or from a street to an alley.
ALLEY:
The word “alley” shall mean a permanent service right-of-way which affords only a secondary means of access from such right-of-way to abutting property and is not intended for general traffic circulation.
AREA LOT:
The term “area lot” shall mean the total area within the lot lines.
BLOCK:
The word “block” shall mean property abutting on one side of a street and lying between the two nearest intersecting or intercepting streets or between the nearest intersecting or intercepting street and railroad right-of-way, waterway, unsubdivided area, or other definite boundary.
BUILDING:
The word “building” shall mean an enclosed structure having a roof supported by columns, walls, arches, or other devices, used for housing, shelter or enclosure of persons, animals or chattels.
COMPREHENSIVE PLAN:
The term “Comprehensive Plan” shall mean the complete plan or any of its parts for the development of the Village as prepared by the Zoning Board or any other planning agency and adopted by the Village Board as the Official Plan of the Village.
DWELLING:
The word “dwelling” shall mean a building designated for residential living purposes and containing one or more dwelling units.
DWELLING UNIT:
The term “dwelling unit” shall mean one or more rooms constituting all or part of a dwelling exclusively as living quarters for one family and not more than two (2) roomers or boarders, and which contains cooking facilities, sink or other kitchen facilities.
DWELLING, SINGLE FAMILY:
The term “dwelling, single family” shall mean a dwelling containing one dwelling unit.
DWELLING, MULTI-FAMILY:
The term “dwelling, multi-family” shall mean a dwelling containing two (2) or more dwelling units.
EASEMENT:
The word “easement” shall mean a right or privilege held by the public, a corporation or person for the use of the land of another for specified purposes.
VILLAGE ENGINEER:
The term “Village Engineer” shall mean a qualified person appointed by the President, with the consent of the Village Board of Trustees, to act as such for this Village.
VILLAGE BOARD:
The term “Village Board” shall mean the President and Trustees of the Village of Creve Coeur.
ZONING COMMISSION:
The term “Zoning Commission” shall mean the Zoning Commission appointed by the Village.
COUNTY:
The word “County” shall mean Tazewell County, Illinois.
FAMILY:
The word “family” shall mean:
(A)   An individual; or
(B)   Two (2) or more persons related by blood, marriage, or adoption; or
(C)   Not more than five (5) persons not so related;
together with his or their domestic servants and gratuitous guests maintaining common household in a dwelling unit.
GRADE:
The word “grade” shall mean the ascending or descending inclination with a horizontal of a street, measured along the center line of the right-of-way, expressed by stating the vertical rise or fall of a percentage of the horizontal distance.
LOT:
The word “lot” shall mean a tract of land within a subdivision on a plat as a numbered, lettered or other identified tract of land to be offered for sale, dedication or development.
LOT LINES:
The term “lot lines” shall mean the lines bounding the lot.
OWNER:
The word “owner” shall mean an individual, firm, association, syndicate, partnership, corporation, company, organization, trust or other legal entity having a proprietary interest in a use, structure, lot, tract or parcel of land.
PARK:
The word “park” shall mean a public area for recreation, rest and relaxation in the open air.
PLANNED DEVELOPMENT:
The term “planned development” shall mean a tract of land developed as a unit under single ownership or control which includes two (2) or more main or principal structures.
PLAT:
The word “plat” shall mean a map, plan or layout showing the subdivision of land into lots.
PLAT OFFICER:
The term “Plat Officer” shall mean the Chairman of the Zoning Board.
PROPERTY:
The word “property” shall mean the general term denoting either singularly or in combination, an area, lot, parcel, tract, plot, or otherwise designated portion of land.
RIGHT-OF-WAY:
The term “right-of-way” shall mean the entire dedicated tract or strip of land which is to be used by the public for circulation or service.
SANITARY SEWER:
The term “sanitary sewer” shall mean a constructed conduit for the collection and carrying of liquid or solid sewage wastes, other than storm water, to a sewage treatment plant.
SCHOOL:
The word “school” shall mean a building or group of buildings and all associated structures, facilities and grounds in or on which instruction in subjects which are fundamental and essential in general education is offered under the supervision of the Tazewell County Superintendent of Schools.
SIDEWALKS:
The word “sidewalks” shall mean that paved portion of the right-of-way which affords the principal means of access to abutting property.
STORM SEWER:
The term “storm sewer” shall mean a constructed conduit for the collection and carrying of surface waters to a drainage course.
STREET:
The word “street” shall mean a public thoroughfare within the right-of-way which affords the principal means of access to abutting property, a street may be designated as an avenue, boulevard, drive, highway, lane, parkway, place, road, thoroughfare, court, or other appropriate name. Streets are identified according to type of use as follows:
(A)   Major Streets:
   1.   Major Thoroughfare, Intermediate Thoroughfare: A street so designated on the Thoroughfare Plan.
   2.   Limited Access Street: A major or intermediate thoroughfare along which exits and entrance ways, provided only at controlled intersections, and from which there is no direct access to abutting properties.
   3.   Collector Streets: A street planned to facilitate the collection and routing of traffic from minor streets to major streets, or intermediate thoroughfares.
(B)   Minor Streets:
   1.   Direct Access Street: A street providing direct access to and/or from streets, alleys and abutting properties.
   2.   Marginal Access Street: A street parallel to a limited access street providing direct access to and/or from streets, alleys, and abutting properties, and providing ways for traffic to reach access points along a limited access street.
STRUCTURE:
The word “structure” shall mean anything constructed or erected with a fixed location on the surface of the ground or underground, or affixed to something having a fixed location on the surface of the ground.
SUBDIVIDER:
The word “subdivider” shall mean an owner who presents a subdivision plat for approval hereunder.
SUBDIVISION:
The word “subdivision” shall mean any division of any lot, area, tract or parcel of land into two (2) or more lots for the purpose, whether immediate or future, of conveyance, transfer, improvement, or sale, with the appurtenant streets, alleys and easements, dedicated or intended to be dedicated to public use, or for the use of the purchasers or subdividers or others, within the part, lot, area or tract divided, except that divisions exempted from the provisions of an Act of the Illinois Legislature entitled: “An Act to Revise the Law in Relation to Plats”, approved March 21, 1874, as amended, and as set forth in Section 1(b) thereof, are not deemed subdivisions for the purpose of this Title.
THOROUGHFARE PLAN:
The term “Thoroughfare Plan” shall mean a part of the Comprehensive Plan which sets forth the general location, alignment, and dimensions and the identification and classification of existing and proposed streets. (Ord. 351, 10-1-69; amd. Ord. 962, 10-26-2022)
