When any person directly interested shall make application to the President and Board of Trustees for the construction of any sidewalk upon any of the streets of the Village, the President and Board of Trustees may order the construction of the same under the supervision of the Board of Local Improvements, of such material and such width as they may direct. The cost of the material and the expense incurred in the construction of such sidewalk shall be paid by the party applying for the same, unless otherwise ordered by the President, and Board of Trustees; provided, that when the party applying for such sidewalk shall desire the same to be over six feet (6') in width. The President and Board of Trustees may so order, if the party applying shall agree to pay all necessary expense incurred thereby, and enter into an obligation to keep such additional width of sidewalk in good condition and repair, without any expense to the Village, so long as said sidewalk shall remain in use, and well and truly keep said Village from all harm, damages and costs of suit, actions, judgments, and executions that shall or may at any time arise, come or be brought against said Village on account of any accident that may occur to any person by reason of said portion of said sidewalk being out of repair or in a dangerous condition at any time hereafter.
