7-4-3: FIRST AMENDMENT RIGHTS:
The village, as trustee for the public has the duty to keep village streets open for movement of people and property, to prevent street littering and to protect the property rights of its citizens; provided, however, that the enforcement of this chapter shall not unreasonably interfere with freedom of speech or freedom of the press. This chapter shall not apply to the distribution of any pamphlet, handbill, circular, newspaper or other printed material (regardless of content) so long as dissemination or distribution is by:
   (A)   Placing the printed material in a receptacle provided by either the distributor or the property owner;
   (B)   Placing the printed material in waterproof containers which are left either on a hook affixed to a delivery post or similar structure;
   (C)   Placing the materials at the entry door;
   (D)   Personal delivery;
   (E)   Mail delivery; or
   (F)   Any other reasonable means of dissemination or distribution that would not impose a burden upon either the village or property owners in cleaning or maintaining public areas or private property. (Ord. 556A, 3-11-1998)
