5-4-1: ADOPT RULES AND REGULATIONS:
   (A)   The International Fire Code, 2018 Edition (“IFC” or “fire prevention code”) as prepared by the International Code Council, and the NFPA 101 Life Safety Code, 2018 Edition (“LSC” or “life safety code”), as prepared by the National Fire Protection Association, are hereby adopted and made a part this chapter by reference thereto, for the purpose of establishing rules and regulations for fire prevention and safety in the village of Creve Coeur. The fire prevention code and life safety code are available for inspection in the office of the village clerk upon request. The fire prevention code and life safety code are incorporated as fully as if set out at length herein, and the provisions thereof shall be controlling. In the event of any inconsistency between the provisions of the IFC, the Life Safety Code or any other provisions of the Village Code, including other codes adopted or incorporated by reference by the Village Code, the terms of the more stringent code as determined by the Fire Chief in consultation with the Building Inspector of the Village shall apply.
   (B)   The following sections of the IFC are hereby revised, completed, or deleted as follows:
      1.    Section 101.1. Insert in place of the bracketed material “Village of Creve Coeur”.
      2.   At Section 110.4 insert: Persons who violate a provision of this code or shall fail to comply with any requirements thereof or who shall erect, install, alter or repair or do work in violation of the approved construction documents or directive of the fire code official, or of a permit or certificate issued under the provisions of this code, shall be punished by a fine as provided in section 4-1-40 of the village code for each offense, together with applicable costs. Each day that a violation continues to exist shall constitute a separate offense.
      3.   Section 112.4 is hereby deleted in its entirety and the following is substituted in lieu thereof: “Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition shall be subject to penalties as provided in section 4-1-40 of the village code.”
      4.   Section 903 pertaining to automatic sprinkler systems is deleted, but only to the extent its provisions were made applicable to new one and two family dwellings.
      5.   Section 5704.2.9.6.1 is hereby completed to read as follows: “in all territory within the corporate limits of the Village of Creve Coeur, Illinois other than those areas of the Village assigned to the ‘I-1 or I-2 Industrial Zoning District’ classification.”
      6.   Section 5706.2.4.4 is hereby completed to read as follows: “in all territory within the corporate limits of the Village of Creve Coeur, Illinois other than those areas of the Village assigned to the ‘I-1 or I-2 Industrial Zoning District’ classification.”
      7.   Section 5806.2 is hereby completed to read as follows: “in all territory within the corporate limits of the Village of Creve Coeur, Illinois other than those areas of the Village assigned to the ‘I-1 or I-2 Industrial Zoning District’ classification.”
      8.   Section 6104.2 is hereby completed to read as follows: “in all territory within the corporate limits of the Village of Creve Coeur, Illinois other than those areas of the Village assigned to the ‘I-1 or I-2 Industrial Zoning District’ classification.”
      9.   Appendices A, B, C, D, E, F, G, H and I of the Fire Prevention Code are hereby adopted. Appendix J is not adopted.
   (C)   The “NFPA 101 Life Safety Code, 2018 Edition” as published by the National Fire Protection Association is hereby adopted and made applicable within the Village of Creve Coeur in the State of Illinois.
      1.   Section 24.3.5.1 pertaining to automatic sprinkler systems in new one and two family dwellings is hereby deleted.
      2.   Sprinkler Requirements. For all structures other than one and two family dwellings and buildings where the only use is storage of non-combustible materials (with no commercial operations or residential occupancy), the automatic sprinkler requirements of the NFPA 101 Life Safety Code, 2018 Edition shall apply to the same extent as with new construction in the following circumstances: (1) where there is a change in ownership of such structure (other than transfers from an individual(s) to a partnership, business entity or trust owned and controlled by such individual(s)), (2) where there is a change of ownership of any commercial operation located in such structure, (3) where there is a change in use or occupancy classification of such structure, or (4) where the owner makes any Renovation, Modification, Reconstruction or Addition to such structure (as such terms are defined in the NFPA 101 Life Safety Code, 2018 Edition). For purposes hereof, a “change of use” shall be deemed to occur upon the occupancy of any structure that has been vacant for more than six (6) months. The owner of any existing structure for which installation of automatic sprinklers is required hereunder shall complete such installation within a period of twelve (12) months from the effective date of the change in ownership (of the property or business occupying the property), change in use or occupancy classification, or issuance of a building permit for any Renovation, Modification, Reconstruction or Addition. The Village Building Inspector, with the approval of the Village President, may grant extensions of the foregoing time for compliance based upon special circumstances demonstrated by the owner. The Building Inspector may approve variations from the requirements of the NFPA 101 Life Safety Code, 2018 Edition where the design or layout of the structure make strict compliance impossible or impractical, provided that in no event shall the automatic sprinkler requirement be waived or eliminated for any residential dwelling unit.
   (D)   All fire department connections on either sprinklers or standpipes shall meet both of the following specifications:
      1.   A 5" locking Storz connection.
      2.   All connections shall be equipped with listed plugs or caps.
In the event of a conflict between this subsection (D) and any provision of any other ordinance or code applicable in the Village including, without limitation, the IFC or the Building Code, then the provisions of this subsection (D) shall govern. (Ord. 701A, 3-12-2014; amd. Ord. 955, 2-23-2022)
