(a) Purpose. The purpose of this section is to ensure that all sewers, including all public and private sewers and all connections to them, are managed, operated and maintained to:
(1) Maximize the efficiency and effectiveness of conveyance and treatment facilities;
(2) Minimize the probability, duration, and magnitude of overflows;
(3) Eliminate the infiltration of storm water.
(b) Acceptable Practices for Connections. No water from downspouts, areaways, cisterns, or the ground surface shall be permitted to enter the sanitary sewer system. The elevation of basement and garage floors shall be designed so storm water cannot enter the sanitary sewer system.
(1) Grades with Footer Drains. The finished grade adjacent to all houses or structures with footer drains shall not be less than a six-inch fall in the first ten feet horizontally. Where the horizontal distance is restricted to less than ten feet by property lines, the minimum fall shall be six inches.
(2) Grades without Footer Drains. The finished grade adjacent to all houses or structures without footer drains shall not be less than a six-inch fall in the first ten feet horizontally. Where the horizontal distance is restricted to less than ten feet by property lines, the minimum fall shall be three inches.
(3) Yard Drainage. Positive yard drainage shall be provided for each lot by means of ditches, swales or tile to natural watercourses or to public storm sewers. Where a lot is graded to a higher or lower level than the natural ground grade on an adjacent property, the owner of the lot shall provide suitable slopes, retaining walls or other protection on his property to preserve the natural slope or surface elevation of the adjacent property. Maximum slope shall be not greater than fourteen percent, unless approval is obtained from the Village Administrator or Village Engineer.
(4) Roof and Footer Drains. Roof drainage shall be handled by suitable collectors and downspouts, which must discharge into storm sewers when available. If storm sewers are not available, downspouts must discharge on suitable splash blocks to conduct water three feet from the foundation, provided the yard slope does not exceed one and one-half percent grade. If the slope of the yard exceeds one and one-half percent grade, and suitable storm sewers are not available, roof drainage shall be tiled from the downspouts to a curb opening at the street or shall be tiled to a natural watercourse. No concentration of water shall flow onto the adjoining property. Where drainage is to the front of lots, the top of the basement wall shall be not less than twenty inches above sidewalk grade.
(5) Splash Blocks. If splash blocks are used, the water shall be directed from the downspouts by means of an elbow to the splash block.
(6) Storm Drain Tile. If storm drain tile is used, the downspout shall discharge into sewer pipe not less than four inches in diameter, from a point not less than six inches above finish grade to an elbow below finish grade, and discharge into the storm sewer connection. The sewer shall be of an approved material, and all joints shall be sealed. The elbow shall be securely blocked up with masonry or braced to the wall with non-corrosive hangars, to prevent settlement.
(c) Foundation Drains.
(1) In any area served by sanitary sewers, foundation drain sump pumps shall discharge to surface drainage, a storm sewer, a storm water detention or retention basin, or any other location that is approved by the Village of Crestline and is not a sanitary sewer or tributary to a sanitary sewer.
A. A foundation drain sump pump may not discharge to a combined sewer at any site that is served by a separate storm water conveyance system.
B. Foundation drains connected to a sanitary or combined sewer before January 2008 may remain connected, unless inspection requires disconnection to reduce inflow. If a foundation drain was connected to a combined sewer before the construction of a storm sewer that serves the property, then the foundation drain may remain connected to the combined sewer, unless the Village of Crestline requires disconnection to reduce inflow.
(2) For structures constructed after December 31, 2008, foundation drain sump pumps shall discharge through a verifiable external pipe.
(d) Inspections.
(1) The Village of Crestline shall conduct inspections for prohibited connections whenever the Village has a reasonable suspicion that:
A. Prohibited connections are likely to be causing or contributing to excessive inflow in a particular sanitary sewer, or
B. A particular prohibited connection is connected to a sanitary sewer line contrary to the requirements of this section.
(2) An inspection plan and schedule may include: inspecting within a certain time, every structure within a particular sewer or a representative sample of these structures; inspecting structures at the time of sale; or inspecting structures as a condition of receiving a building permit.
(3) Before inspections occur, the Village of Crestline shall provide notice to both the owners and the occupants of the structures to be inspected. This notice shall indicate the range of dates and times when the inspection may occur and the reasons for the inspection.
(4) The scope of the inspection shall be limited to determining whether connections comply with the Ohio Building Code 2007, this section, and any other related requirements of the Village.
(5) The owner or occupant of any structure shall allow the Village of Crestline to inspect sewer connections and any related piping at any reasonable time after receiving notice from the Village of Crestline of its plans to perform inspections, according to the requirements of this section and any other applicable law.
(e) Prohibited Connection Enforcement.
(1) If the Village of Crestline possesses any credible evidence showing that a connection is in violation as outlined, then the Village shall notify both the owner and the occupant of the structure of the violation and require remedial action.
(2) The Village of Crestline shall allow a reasonable length of time to complete the remedial action and advise the owner and occupant in writing. The length of time to remediate the violation shall be set by the Village Administrator based upon the complexity of the repair.
(3) If the owner or occupant of a structure does not consent to an inspection undertaken according to the requirements as set forth above, then the Village of Crestline shall cease providing water, sewer service or other municipal services to that structure or take other effective action. The Village shall terminate these services according to any applicable requirements of the Villages Codified Ordinances and any other applicable requirements.
(f) Submerged Manholes. If a sanitary sewer manhole is in a 100-year floodplain or is submerged for significant periods by storm water runoff, then the manhole shall have a solid and non-vented cover and the portion subject to freeze and thaw cycles shall be sealed to effectively prevent infiltration.
(g) Inconsistent Provisions Repealed. All ordinances, rules and regulations inconsistent with the provisions of this section are hereby repealed.
(h) Violations. Whoever violates subsections (b) or (c) hereof and fails to remediate the violation in the time provided under subsection (e) shall be guilty of a misdemeanor of the fourth degree. In addition, the Village may seek an injunction or pursue an action in Common Pleas Court to abate any nuisance caused by the violation.
