509.08 PICKETING NEAR A FUNERAL SERVICE.
   (a)   As used in this section, the following definitions apply:
      (1)   "Picketing" shall mean conduct by a person or group of persons gathered for the purpose of expressing a point of view orally and/or by the display of signs.
      (2)   "Funeral service" shall mean any gathering of people with the purpose of honoring or memorializing a person who has recently died with or without the deceased's remains being present, including those gatherings held in funeral homes, public or private places of assembly, including churches, or cemeteries.
   (b)   No person shall engage in picketing on any public or private property within one thousand (1,000) feet of the nearest boundary of the property where a funeral service is or is to be conducted which targets any person attending the funeral service within one hour before, during or within one hour after said service.
   (c)   That any person who violates subsection (b) hereof shall be guilty of a minor misdemeanor and upon a second or subsequent violation within one year of a conviction of a violation of subsection (b) hereof shall be guilty of a misdemeanor of the fourth degree.
