No such swimming pool, exclusive of portable swimming pools with a diameter less than twelve feet or with an area of less than 100 square feet, shall be allowed, except as an accessory use to a resident and unless it complies with the following conditions and requirements:
(a) A permit for the installation of a swimming pool must be obtained from the Municipality through the Superintendent of the Building Department and payment of a fee of twenty dollars ($20.00) or such other fee as may be stated in Section 1329.01(f) of this Building Code.
(b) The pool is intended and is to be used solely for the enjoyment of the occupant and guests of the resident occupant of the premises.
(c) The swimming pool and any accessory structure adjacent thereto, may not be located closer than five feet to any property line of the property on which it is located.
(d) The swimming pool shall be so walled or fenced to a height of not less than five feet and shall be maintained in good condition with a gate and a lock.
