The following policies and procedures shall be applicable to the Residential Board of Appeals and its members:
(a) A member shall not hear an appeal in which that member has any personal, professional or financial interest.
(b) The Board shall meet upon notice from the chairperson, or at stated periodic meetings. Three members shall constitute a quorum.
(c) All hearings before the Board shall be open to the public. The appellant, the appellant’s representative, the Code official, and any person whose interests are affected shall be given an opportunity to be heard.
(d) The Board shall adopt and make available to the public, through the secretary, procedures under which a hearing will be conducted. The procedures shall not require compliance with strict rules of evidence, but shall mandate that only relevant information be received. The procedures shall not conflict with any applicable provision of this chapter.
(e) All meetings of the Board shall be public, but the Board may, upon a motion passed by a majority of its members, go into executive session for the purpose of deliberations after it has heard all of the evidence.
(f) The Board shall modify or reverse the decision of the Code official by a concurring vote of three members.
(g) The decision of the Board shall be by resolution.
(h) The Code official shall take immediate action in accordance with the decision of the Board. (Ord. 2759. Passed 1-22-07.)
