§ 111.02 LICENSE REQUIRED; FEE.
   (A)   No person shall engage in any transient retail business within the borough without first obtaining from the Borough Enforcement Officer (or in his or her absence the Borough Secretary) a license and paying the fee established from time to time by resolution of Council, which shall be for the use of the borough.
   (B)   The applicant shall have the privilege of determining whether to obtain an annual or a daily license; provided; no license fee shall be charged under this section:
      (1)   For the sale of goods, wares and merchandise, donated by the owners thereof, the proceeds whereof are to be applied to any charitable or philanthropic purpose; and
      (2)   To any manufacturer or producer in the sale of bread and bakery products, meat and meat products, or milk and milk products, but all persons exempted hereby from payment of the license fee shall be licensed without fee.
   (C)   Any person dealing in one or more of the hereinabove mentioned exempted categories, and selling other goods, wares and merchandise not so exempted, shall be subject to payment of the license fee fixed by Council for his or her activities in connection with the sale of goods, wares and merchandise not in such exempted categories.
   (D)   The Borough Enforcement Officer, with the permission of the Mayor, may similarly exempt from payment of the license fee, but not from registering with him or her, persons working without compensation and selling goods, wares or merchandise for the sole benefit of any nonprofit corporation.
   (E)   Every license issued under the provisions of this chapter shall be issued on an individual basis to persons engaging in such businesses; every such individual shall obtain a separate license, issued to him or her in his or her name, and the license fee hereby imposed shall be applicable to every such individual license.
