2. 3. In the event that both of the volunteer fire companies respond to the scene, they shall each receive 1/2 of the cost collected by the borough. In the event that only one of the volunteer fire companies respond to the alarm, that company shall receive the entire cost sum recovered by the borough. | |
4. In the event that any response fee is not paid to the borough within 30 days after notice being mailed by the Borough Secretary/Treasurer, the Solicitor is empowered to file a civil complaint for said sum and costs, including reasonable counsel fees, with the district justice having jurisdiction over such matters for the borough. | |
5. The borough shall have the absolute right to waive any costs for any response(s) in its sole discretion. | |

In the event that the review fee is depleted to 50% of the fee paid at the time of plan submission or resubmission, the applicant shall furnish to the borough upon notification by invoice from the Borough Secretary/Treasurer, a supplemental fee deposit in the amount of 50% of the initial fee payable within ten days of receipt of such notification. Failure to replenish the review fees as instructed by the borough, shall result in a stoppage of plan processing. All review fees shall be paid in full prior to final plan approval. Review fees not expended shall be refunded to the applicant. | |
Review fee waiver at final plan stage | If review fees held by the borough are in excess of 50% of the initial fee submitted at the time of final plan submission, no additional review fee shall be required to be paid at that time, but may be required later. |
Road dedication - escrow | At the time a developer files a written request for the borough to accept dedication of a street(s) in a development, the developer shall deposit an escrow sum, the money from which will be used to pay for legal, engineering, advertising costs, title work, and other ancillary costs incurred by the developer in the acceptance of a deed of dedication to a street(s). In the event the escrowed funds are not sufficient, the Borough Secretary/Treasurer shall demand additional sums from the developer which shall be deposited to the escrow account and used to pay said costs. |
In the event the developer fails to pay the initial escrow or such other additional escrow demanded by the Borough Secretary/Treasurer, all work on the dedication process shall cease until if and when said escrow requirements are met by the developer. | |
If any funds remain after the dedication project has been completed, such funds shall be returned to the developer. | |
Borough to record plans | Any final plans approved by the Borough Council shall be recorded by the borough as expeditiously as possible after approval in the office of the Recorder of Deeds of the county, cost of plan recording to be that of the applicant or developer. No plans to be recorded until all fees are paid to the borough. |
Release of plans | No plans shall be released by the borough until all fees due to the borough have been paid. |
Return of fees | Any unused portion of any fee required under this schedule will be returned to the applicant upon withdrawal, disapproval or upon approval of any plan, with respect to all subdivision reviews or land development plans whether they be residential or commercial in nature. |
Fees payable | All fees or sums required pursuant to the provisions of this schedule shall be payable to the “Borough of Cressona” and tendered to the Borough Secretary/Treasurer. |
Review costs | The developer shall be responsible to pay for the review costs charged by the Borough Engineer and Attorney as well as any other experts which the Borough Council determine are necessary to properly evaluate a pending subdivision or development plan, as well as any other direct expenses incurred by the borough in evaluating a subdivision or land development plan, to which sums shall be added an administrative fee of 10% thereof to cover the borough administrative costs associated with the handling and administrative work on any pending subdivision or development plan. In the event the developer makes full payment of incurred fees/costs within 10 days of invoice date, the borough at its sole discretion, has the right to refund the aforesaid administrative fee. |
Contact person - developer | At the time the developer submits his or her subdivision/land development plan and pays the prescribed fees contained herein, the developer shall also designate one individual and provide his or her address and telephone number, who shall be the sole contact person between the borough and the developer. |
Miscellaneous plan submission requirements | The borough shall not accept any subdivision/land development plan submissions without the following information: |
A. Universal parcel identifier number being clearly labeled on the first sheet of the plan set. | |
B. Plan set size is not greater than 24 in. by 36 in. | |
C. Deed book and page number(s) is (are) referenced on the plan set. | |
D. Final plan submissions to be properly signed and notarized in accordance with § 154.052(B)(29) of this code of ordinances. | |
Taxation, special | |
1. The Tax Collector of the Borough of Cressona is hereby authorized to charge taxpayers and interested individuals the following sums for tax information | |
A. For telephone information relating to the payment status of taxes, the Tax Collector may charge for information relating to each taxpayer per UPI number (i.e., if the requesting individual request tax information relating to three separate UPI numbers, the Tax Collector may charge a fee of $6) | $2 |
B. For written information relating to the payment status of taxes, the Tax Collector may charge per UPI number for information relating to each taxpayer | $5 |
2. In the event that a taxpayer does not pay the full amount of the check not honored by the drawee bank, together with the service fee of $20, within a period of 10 days, the Tax Collector shall send the said taxpayer a 10-day notice by certified mail, return receipt to replace the dishonored check pursuant to the provisions of 18 Pa.C.S.A. § 4105(b)(1)(ii). | |
3. In the event the Tax Collector forwards a 10-day demand letter to the taxpayer as specified above, and the taxpayer refuses or fails to replace said check with a cash payment equal to the unpaid taxes and the aforesaid $20 service fee, the Tax Collector shall forward all records and documents to the Schuylkill County District Attorney’s Office for possible criminal prosecution pursuant to the provisions of 18 Pa.C.S.A. § 4105. | |
4. The Cressona Borough Tax Collector shall, effective upon the date of this schedule, conspicuously display a written notice in his or her office that a $20 service charge will be levied on all checks not honored by the drawee bank in accordance with the provisions of 18 Pa.C.S.A. § 4105(e)(3). | |
5. The Tax Collector of the borough shall report all service funds collected under this schedule to the Borough Council on a monthly basis. | |
6. The Tax Collector of the borough shall be entitled to retain all funds collected pursuant to the terms of this schedule as compensation. | |
