(A) During times of disaster and emergency as required by KRS 39D.040(4), if the Mayor is unavailable during a state of emergency as defined in KRS 39D.040(1)(d), then the person named as Vice-Mayor by Executive Order shall exercise the powers of Mayor as authorized by KRS 83A.130(7) and § 31.14.
(B) Any Vice-Mayor who assumes the duties of Mayor during a time of disaster or emergency, shall as one of the first duties of office, issue an Executive Order naming a new Vice-Mayor in the event that he or she may also become unavailable or unable to attend to the duties of Mayor.
(C) At any time during a disaster or emergency as required under KRS 39D.040(4), if there is no Mayor or Vice-Mayor in position to exercise the duties of the Mayor’s office, then the order of succession to exercise the duties of Mayor shall be as follows:
(1) Chief of Police.
(2) Director of Public Works.
