§ 94.99 PENALTY.
   (A)    In arriving at realistic penalties for violations of provisions contained in this chapter, the primary objective has been to establish them as part of the simplest possible enforcement system. The system has these features.
      (1)    A mail-in ticket which:
         (a)    Identifies the violator.
         (b)    Lists and identifies violations of the ordinance provisions by section numbers.
         (c)    States the prescribed fine beside each violation listed.
         (d)    Provides simple instructions on where the ticket is to be mailed with a check or money order in the amount of the stipulated fine.
         (e)    States a simple procedure to follow if the violator elects to appear in court to plead his case rather than mail in the fine.
      (2)    Use of the above ticket by all department and agency personnel authorized to enforce the sections of the ordinance.
      (3)    Use for particularly flagrant violations (dumpouts, garbage spreading from badly-overloaded solid waste containers, debris-strewn property, and such). This would be in the form of a direct summons to court, with penalty range substantially above those on the mail-in ticket.
   (B)    Fines.
      (1)    Any person who shall violate a provision of this chapter shall, upon conviction thereof, be subject to a fine of not less than $50 nor more than $500. Each day that a violation continues shall constitute a separate offense.
      (2)    At the discretion of the enforcement office, a citation and mail-in ticket may be used as provided above, with fines of $50 for the first offense and $100 for each subsequent offense during a one year period, which fines shall double if not paid within five business days after the issuance of a citation and the violator will be cited to appear before the Kenton District Court. The Court may impose a fine of $50 to $500, as provided above.
      (3)    For serious violations, the enforcement office may cite the offender directly to Kenton District Court. Without using the citation procedure.
