§ 130.05 CONSUMPTION OF ALCOHOLIC BEVERAGES.
   (A)   Alcoholic beverage as used in this section is defined the same as the term is defined in G.S. § 18B-101(4).
   (B)   Except as provided in this section, it shall be unlawful to consume or possess any open alcoholic beverages in, or for any person under the influence of alcohol to enter or remain on or upon any public place, park, building, street, sidewalk, alley or parking lot owned, leased or maintained by the city, county or state.
   (C)   The consumption of alcoholic beverages shall be lawful on or upon property owned or leased by the city, upon securing the necessary rental agreement or special event permit from the city, and the necessary permit from the North Carolina Alcoholic Beverage Control Commission. Any person or group requesting such permissions shall submit all necessary permits and rental applications to the city prior to the event. The City Manager shall grant or deny such permits or applications after consultation with the Police Chief.
   (D)   It shall be unlawful to consume or possess any open any alcoholic beverages upon the private property or private business premises of another, without permission of the owner or person entitled to possession of such premises, unless such beverages can be consumed as provided by law.
   (E)   It shall be unlawful for any person to consume or possess any open alcoholic beverage in any park. It shall be unlawful for any person under the influence of alcoholic beverages to enter or remain in any park.
   (F)   It shall be unlawful to drop, throw, cast or deposit any alcoholic beverage container in any public place other than a bona fide trash disposal site or utensil; upon any public street, sidewalk, alley or parking lot; or upon the private premises of another without permission of the owner or person entitled to possession of such premises.
   (G)   It shall be unlawful for any person to consume or possess any open alcoholic beverages in or upon a motor vehicle or motorized bicycle in or upon any public place; in or upon any street, sidewalk, alley or parking lot; or upon the private premises of another, without permission of the owner or person entitled to possession of such premises.
