§ 115.06 APPEAL.
   (A)   An applicant who's application is denied, suspended or revoked by Code Enforcement Officer may appeal such action in writing within 30 days, to the City Board of Commissioners, who shall decide either to uphold the action or to issue the license not later than the second regular town board meeting after receipt of the appeal. The applicant or licensee shall have the right to present evidence before the City Board. The decision to uphold the action of the Code Enforcement Officer or issue the license shall be based solely on the criteria established in this article for the action by the Code Enforcement Officer. A suspension or revocation shall be stayed during the pendency of an appeal to the City Board.
