§ 111.17  PROPER TREATMENT OF PASSENGERS.
   (A)   No certificate holder or operator shall deceive or attempt to deceive a passenger or prospective passenger as to his or her destination or rate of fare to be charged.
   (B)   No certificate holder or operator shall deceive or attempt to deceive a passenger or prospective passenger as to his or her identity.
   (C)   No operator shall take a longer route to the destination directed by the passenger than necessary, unless requested to do so by the passenger.
   (D)   No certificate holder or operator shall permit any person other than the original passenger to occupy or ride in the taxicab without the consent of the original passenger.
   (E)   No operator shall allow the seating capacity of his or her passenger vehicle for hire to exceed manufacturer’s specifications.
   (F)   No certificate holder or operator shall refuse or neglect to transport any person on the basis of race, color, religion, sex or national origin. In addition, no certificate holder or driver shall refuse or neglect to transport any person on the basis of disability when such service can be provided to a person with a disability with a reasonable accommodation.
   (G)   No certificate holder or operator shall refuse or neglect to transport any person requesting service on the basis of the time of day of the request or on the basis of the geographical area of the town or city to be served.
   (H)   A certificate holder or operator may refuse or neglect to transport an orderly person upon request, only if the operator has made visual contact with the person and formed a belief that is reasonable under the circumstances that transporting such person might be unsafe for the driver. Nothing contained in this section shall authorize an operator to refuse or neglect to transport any person as a pretext to the driver’s noncompliance with the provisions of division (F) above.
   (I)   All certificate holders and operators shall provide prompt, efficient service and be courteous at all times to the general public, to other passenger vehicle for hire drivers, to the Taxicab Administrator and to any law enforcement officer.
   (J)   No certificate holder or operator shall operate or allow a vehicle to be operated in a manner that threatens, endangers or abuses a passenger or the general public.
   (K)   No certificate holder or operator shall knowingly solicit, procure or give information in regard to or transport any passenger to any person for the purpose of prostitution.
   (L)   No operator shall operate a passenger vehicle for hire or taxicab while under the influence of, or while having the odor of, an alcoholic beverage or controlled substance on or about his or her person. No certificate holder shall allow any operator to operate a passenger vehicle for hire or taxicab while consuming, while under the influence of, or while having the odor of, an alcoholic beverage or controlled substance on or about his or her person.
   (M)   Any operator charged with a criminal offense or infraction, he or she shall notify the Taxicab Administrator within 24 hours and shall produce evidence of the disposition of the case as soon as it is available. Failure to do so will result in the suspension of the driver’s permit.
   (N)   Certificate holders shall be responsible for the compliance of their affiliated operators with the provisions of this section. Failure of an operator to comply with said provisions may result in the issuance of citations to the passenger vehicle for hire company and/or the operator pursuant to this section.
   (O)   No operator shall operate a passenger vehicle for hire within the town without a valid driver’s license or while his or her driver’s license is revoked or suspended.
   (P)   No certificate holder or operator shall knowingly use, sell, handle or transport illegal or controlled substances at any time while operating a passenger vehicle for hire. In addition, no operator shall give information to any passenger as to where or how illegal or controlled substances may be obtained nor shall any driver knowingly and willfully transport any person for purposes of obtaining illegal substances.
   (Q)   No certificate holder shall operate or allow the operation of a passenger vehicle for hire while his or her certificate is in a state of suspension or revocation.
   (R)   No operator shall operate a passenger vehicle for hire while his or her operator’s permit is in a state of suspension or revocation.
   (S)   No operator or passenger(s) are permitted to possess a lit cigarette, cigar, pipe or tobacco of any kind or incense inside a passenger vehicle for hire.
