§ 155.31 PUBLIC TREE CARE.
   (A)   The town shall have the right to plant, trim, spray, preserve and remove trees, plants and shrubs within the lines of all streets, alleys and public grounds as may be necessary to ensure safety when servicing town utilities or to preserve the symmetry and beauty of such public grounds.
   (B)   The town may remove, or cause to be removed, any tree or part thereof which, by reason of its nature, is injurious to sewers, water lines or other public improvements.
   (C)   The town, with the property owner’s consent and at his or her expense, may also treat or remove trees infected with an injurious fungus, insects or pests that pose a threat to other vegetation.
