The town is to pick up employee contributions to the State Retirement System, pursuant to Wyo. Stat. § 9-3-412 and with the meaning of I.R.C. § 414(h)(2), being 26 U.S.C. § 414(h)(2), as follows.
(A) The town specifies that contributions, although designated as employee contributions, are being paid by the town in lieu of contributions by the employee.
(B) The employee is not given the option of choosing to receive the contributed amounts directly instead of having them paid by the town to the pension plan.
