Residential-scale businesses are permitted with the granting of a compliance permit and conformance with the following standards.
(A) In general, the residential-scale business shall be designed and operated such that the residential character of the area is retained, the business is highly compatible with residential uses and foreseeable negative impacts to nearby residences are avoided.
(B) All outdoor lighting shall be planned and installed to be compatible with the residential character of the area. Area lighting shall utilize full cut-off shields and shall not be placed more than 18 feet above ground level. Excessive site lighting is prohibited and lighting of adjoining properties shall be minimized.
(C) Signage is limited to a single sign, no larger than 20 square feet. The sign shall not flash, blink, be lighted with colored light, be internally illuminated or have any movable parts. The top of the sign shall be located no higher than five feet from ground level. The sign shall harmonize with the exterior of the building and be a material that can be maintained. Any freestanding sign shall be located at least ten feet back from any property lines. Electronic reader boards are prohibited. In addition, one neon sign not exceeding three square feet is allowed.
(D) New buildings shall be designed using residential-style architectural features, as similar to features found among existing residential buildings in the town. Commercial architectural styles featuring metal-sided buildings, flat roofs, large expanses of windows and similar non-residential features are prohibited.
(E) No commercial structures shall be larger in size, in any dimension, than an average-sized house in the neighborhood. The site shall not have open storage.
(F) On-site parking areas shall be provided with a sufficient number of parking spaces to accommodate expected parking needs in excess of that which can be met on-street in front of the property. Such off-street parking areas shall be located to the side or rear of the building and not in front. Such off-street parking areas shall not be located within the required building setback area, as specified in §§ 152.110 through 152.118. Solid fencing and/or landscaping may be required between parking areas and adjoining residences.
(G) To the fullest extent practical, lawns, trees and other landscaping shall be maintained around buildings and parking areas.
