§ 35.102 PROCEDURES FOR CERTAIN CAPITAL PROJECTS REQUIRING ARCHITECTURAL OR ENGINEERING SERVICES.
   (A)   When a project requiring architectural or engineering services with project costs exceeding $50,000 is proposed by the city, except as provided by divisions (B) and (C) below, the city shall:
      (1)   Transmit a notice requesting a statement of interest in the proposed project from all firms that have a current qualifications statement on file;
      (2)   Give adequate public notice of the proposed project, which may include posting on the Internet or newspaper advertisement, requesting that firms submit qualification statements and statements of interest in the proposed project; or
      (3)   Contact an appropriate professional organization for a list of firms capable of providing the necessary services.
   (B)   If the regulations of a federal department or agency require a procurement process that is different from the process in the city’s capital project A and E procurement method in order that financial aid can be granted, then the city may utilize a written procurement determination to exempt itself from the provisions of the city’s capital project A and E procurement method. Exemption from the city’s capital project A and E procurement method alone shall not exempt the city from utilizing the required provisions of the local procurement policy.
   (C)   When the city has formed a working relationship with one or more firms based on work previously contracted between them, then the city may enter directly into negotiations according to § 35.104. If no contract is successfully negotiated, then the city shall comply with this section, § 35.103, and § 35.104.
   (D)   The city shall not be required to utilize, but is not prohibited from using, the city’s capital project A and E procurement method for projects whose costs are $50,000 or under.
