§ 50.21 WHEN STORM WATER MANAGEMENT FEE PAYABLE; PENALTIES, LIEN ON RENTAL PROPERTY; ABATEMENT OF SMALL AMOUNTS DUE.
   (A)   The fee shall be billed by the city as set forth on the schedule herein. The city makes the following findings regarding billing:
      (1)   That Single Family Residential properties shall receive a single bill, similar to current city practices for billing solid waste disposal user fees, with a bill due date no later than March 31.
      (2)   All other properties subject to the fees set forth herein shall be billed quarterly, in arrears, i.e., a bill for Jan-March, will be issued on or about April 1. The city makes a finding that many commercial bills are in excess of the Single Family Residential and in order to continue to provide the proper budgeting that the Commercial Properties have had with Sanitation District No. 1 issuing quarterly bills, that said practice shall continue.
   (B)   If a bill is rendered to a party who is not the property owner and the bill becomes unpaid and/or delinquent, then the property owner shall bear the responsibility of payment. The city may add delinquent storm water and flood management fees and associated penalties to a property tax bill.
   (C)   A delinquent fee that is not paid by the delinquency date shown on the bill will incur a penalty of ten percent of the bill.
   (D)   A delinquent fee that is not paid by the delinquency date shown on the bill will incur a penalty of 10% of the total bill, when overdue shall constitute a lien on real property and may be collected by a suit against the property owner or in an in rem action against the property.
