Authority for the adoption of this system of user fees to fund the implementation of storm water and flood management program is derived from KRS 91A.510 - .530. which allows for the adoption of a user fee for the City of Covington's storm water quality program, which Covington is required to adopt through the NPDES Phase II storm water program that is an unfunded mandate by state and federal law, and for the flood management aspects of the storm water and flood management program that will be funded by the Storm Water and Flood Management Fee. In addition, pursuant to KRS 82.082, Covington has home rule authority to provide for the health and safety of its residents regarding storm water and flooding.
