For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
AGENTS AND EMPLOYEES. All persons employed by a merchant guard, merchant patrol or detective agency, in the conduct of his or her business, except stenographic and clerical employees whose duties are confined entirely to stenographic and clerical duties in the business office of the merchant guard, merchant patrol or detective agency, or other employees not directly engaged in providing protection or surveillance.
BUSINESS OR INDUSTRIAL GUARD. Any individual who accepts employment from a single employer for the purpose of watching, guarding or otherwise protecting the persons or property of that employer only, or to preserve the peace in the conduct of that employer’s business. BUSINESS OR INDUSTRIAL GUARD shall not include any individual so employed by any common carrier engaged in interstate commerce, or maintenance persons and installers, janitors, repair persons or persons engaged in similar occupations, or officers of the city or county police departments engaged in off- duty employment.
DETECTIVE AGENCIES. Any person who engages in the business of furnishing a service for clients for any type of private investigation.
MERCHANT GUARD or MERCHANT PATROL. Any person who conducts or is engaged in the business of providing protection to persons and property or preserving the peace in the conduct of any business, except a business or industrial guard.
SPECIAL INVESTIGATOR or INDEPENDENT INVESTIGATOR. Any individual who engages in the business of furnishing information or private investigation, including bodily injury cases for other persons or clients. Information developed or fees earned on any individual case or file shall be privileged material and not subject to review as herein provided.
