§ 94.035 DEVOU PARK ARCHAEOLOGICAL EXCAVATION PERMIT.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      ARCHAEOLOGICAL SITE AND OBJECT OF ANTIQUITY. The same meanings as in KRS 164.710.
      KENTUCKY ANTIQUITIES ACT. KRS 164.705 to 164.735 and KRS 164.990.
   (B)   No person shall explore, excavate, appropriate or remove from any portion of Devou Park any archaeological site or object of antiquity without first obtaining a permit from the City Manager.
   (C)   An application for a permit under this section shall be submitted on a form provided by the city. No permit shall issue unless it has been approved by the City Manager or his or her designee and by the Behringer-Crawford Museum.
   (D)   If exploration or excavation of archaeological sites and the finding and gathering of objects of antiquity is undertaken for the benefit of reputable museums, universities, colleges or other recognized scientific or educational institutions with a view to promoting the knowledge of archaeology or anthropology, permits shall be regularly granted.
   (E)   The permitting requirements of this section shall be in addition to the permitting requirements of KRS 164.720. No permit shall issue under this section unless the applicant has obtained a permit from the state’s Department of Anthropology pursuant to the state’s Antiquities Act.
   (F)   The City Manager or his or her designee shall be authorized to promulgate rules and regulations for the issuance of permits under this section; provided that, no such rule or regulation may be in conflict with any provision of this section.
