(A) Every determination required by the Kentucky Model Procurement Code or this subchapter, made by an employee or official of the city, who is engaged in or responsible for the performance of procurement, shall be made in writing. Written determinations shall be maintained in the city’s official contract file. For small purchases authorized in § 35.076, required written determinations may be maintained in the city’s accounting software when time will not permit creating a formal written determination.
(B) In such an instance, a purchase order for under $40,000:
(1) Entered into the city’s accounting software;
(2) Approved by the appropriate department head and the City Manager (or his or her qualified designee); and
(3) Accompanied by the appropriate documentation as detailed by this subchapter, will qualify as a sufficient written determination.
