5-1-14: DELIVERIES AND PICK UPS AT BUSINESS ESTABLISHMENTS ADJACENT TO RESIDENTIAL USES:
   A.   Definition: A business establishment is adjacent to a property zoned or used for residential purposes when it is situated upon land either abutting (contiguous to) real estate zoned or used for residential purposes or separated therefrom only by a street or alley, except, however, those properties separated by LaGrange Road, 55th Street, Joliet Road, Willow Springs Road, or Plainfield Road, or Brianard Avenue, or whose nearest lot line to the business establishment is in excess of one hundred feet (100') from the nearest lot line of that business establishment, shall not be deemed to be adjacent for purposes of this section. The existence of a fence, wall, bushes or similar structure or shrubbery between the business establishment and the property zoned or used for residential purposes shall not exempt such establishment from the application of this section.
   B.   Hours Of Delivery And Pick Up And Exceptions: Deliveries to or pick ups by means of delivery trucks from any business establishment adjacent to a property zoned or used for residential district purposes, of any materials and/or supplies for production or product manufactured on the premises for delivery to customers, are hereby limited in accordance with the following schedule:
      Monday through Friday   7:00 A.M. to 8:00 P.M.
      Saturday         8:00 A.M. to 6:00 P.M.
      Sunday         12:00 P.M. to 6:00 P.M.
   Pick ups and deliveries are also prohibited on the days when the following holidays are celebrated: Christmas, New Year's, Memorial Day, July 4, Labor Day and Thanksgiving Day.
   C.   Idling Of Engines Prohibited: The idling or continued running of the truck or refrigeration unit engine of any vehicle parked for the purpose of loading or unloading at any business establishment adjacent to a property zoned or used for residential purposes is hereby prohibited. All such engines shall be turned off as soon as the vehicle is parked, regardless of whether or not loading or unloading operations are actually in progress.
   D.   Posting Of Notice: Any person who owns, operates, manages or otherwise controls a business establishment subject hereto shall post in a conspicuous place or places, and in a manner which will cause the same to be seen by any person making pick ups or deliveries at such establishment, a sign or signs with language the same, or substantially the same, as the following:
      ALL DRIVERS SHUT OFF ENGINES AND REEFERS

   E.   Restrictions On Operation Of Garbage And Other Trucks And Equipment During Certain Hours: Deliveries or pick ups from any business establishment adjacent to a property zoned or used for residential purposes, by all other trucks, including, but not limited to, those used for garbage and refuse collections, scrap paper bale pick up and recycling, and all street sweeping and construction equipment and machinery, are hereby limited in accordance with the schedule set forth in subsection B of this section.
   F.   Exceptions And Waivers: These restrictions imposed by this section do not apply to deliveries and pick ups made at an entrance on the opposite side of that part of the business premises that faces a property zoned or used for residential purposes. They shall also not apply to pick ups by retail customers in passenger vehicles. Further, any of these restrictions may be waived temporarily when warranted by seasonal or other special demands upon permission granted by the chief of police or city administrator.
   G.   Enforcement: The provisions of this section may be enforceable by fine, declaratory judgment or injunction against the owner(s), manager(s), or other person(s) in charge of any business establishment subject hereto; or against owner(s), manager(s) or other person(s) in charge of the premises, such as a mall or shopping center, in which the business is located; also, the provisions of subsections B and C of this section shall be enforceable by such measures against the driver and/or owner(s) of any vehicle used for pick ups or deliveries at business establishments subject hereto, or the employer(s) of any such driver or owner.
