6-1-4: REMOVAL AND RECOVERY OF VEHICLES:
   A.   Removal By Police:
      1.   Any vehicle, wherever found, whether on public or private property, in violation of this code or other ordinances of the city or the laws of the state is hereby declared to be a nuisance, and the same may be summarily abated by removing it, under the direction or at the request of a police officer, to a place of storage by means of a towing truck or otherwise, or such police officer may require the driver or owner to remove such vehicle off the paved or traveled portion of a street.
      2.   Any vehicle found upon the streets of the city in such a damaged condition or state of disrepair that it cannot be driven and which, in the opinion of a police officer, constitutes an obstruction of the street, may be removed and impounded by the police division to a place of storage; provided, that if the owner or operator has requested, such vehicle may be towed to the owner's own garage or any other garage.    B.   Recovery Of Stored Vehicles: Before the owner or his/her agent shall be permitted to remove a vehicle from the place of storage set forth in subsection A of this section, he/she shall:
      1.   Furnish satisfactory evidence to the director of public safety and the person in charge of such storage area of his/her identity and ownership of such vehicle. (1971 Code § 14-5; amd. 2000 Code; Ord. 923, 12-18-2013)
      2.   Pay to the person in charge of such storage area for the towing of such vehicle the sum in such amount as provided by ordinance of the city council from time to time as a storage charge. (Ord. 783, 2-15-2006; amd. Ord. 923, 12-18-2013)

   C.   Effect Of Removal On Prosecution: The removal of a vehicle which is parked in violation of this code or other ordinance of the city or the laws of the state shall not prevent the prosecution for violation of such laws. (1971 Code § 14-6; amd. Ord. 923, 12-18-2013)
