4-3-2: ABATEMENT PROCEDURE:
   A.   Notice To Abate: In the event of failure to comply with the provisions in section 4-3-1 of this chapter, the Code Enforcement Officer or his/her designee may serve upon the owner, tenant or occupant of the land a notice ordering the owner, tenant or occupant to cut, remove or eradicate the vegetation which is in violation of said section 4-3-1 of this chapter. The notice may be served upon the owner, tenant or occupant personally, or sent by United States first class mail, postage prepaid. The notice shall order that the conditions which violate section 4-3-1 of this chapter be abated within five (5) days after service or mailing of the notice. The notice shall state that in the event of failure to comply with the order, the nuisance will be abated by the City or its designee at the expense of the owner of the property.
   B.   Abatement By City: In the event that the conditions which violate section 4-3-1 of this chapter are not abated within five (5) days after service or mailing of the notice, the Code Enforcement Officer or designee shall abate the condition and shall keep a record of all time, material and equipment used in such abatement.
   C.   Costs To Owner; Administrative Fee: In the event that the Code Enforcement Officer or designee abates the violation of section 4-3-1 of this chapter, a record showing the cost of such work attributable to each property shall be delivered to the Finance Director, and the owner shall be charged for said cost. In addition to the cost of the work, the owner shall pay an administrative fee in such amount as provided by ordinance of the City Council from time to time.
   D.   Costs Assessed: If said cost and administrative fee are not paid within thirty (30) days, the City Council shall assess and levy and cause to be collected the amount of said charges as a special assessment against the property, plus interest at such amount as provided by ordinance of the City Council from time to time.
