§ 110.34  FIREWORK SALES.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      NON-PROFIT ORGANIZATION. Any non-profit corporation or other organization which has been organized for not-for-profit purposes and which sells fireworks at retail to raise funds to carryout said purposes.
      PERMISSIBLE FIREWORKS. Those fireworks as defined in Neb. Rev. Stat. 28-1241(7) that can be sold to the general public at retail.
      RETAILER. Any person or entity engaged in the business of making sales of fireworks at retail to consumers.
   (B)   It shall be unlawful for any person or entity to sell, hold for sale, or offer for sale as a retailer any permissible fireworks within the corporate limits of the municipality without first having obtained a permit from the municipality. Application for the permit shall be made to the Village Clerk on a form prescribed by the municipality.
   (C)   Each application for a permit shall be accompanied by the following permit fee:
      (1)   For-profit persons or entities: $500; and
      (2)   Non-profit organizations: $100.
