§ 51.09  MINIMUM RATES.
   (A)   The governing body has the power and authority to fix the rates to be paid by the water consumers for the use of water from the Water Department. No flat rates shall be quoted or allowed. All water must be metered and charged for at the metered rate. No water service shall be furnished to any customer inside or outside the municipality under any other rate than is allowed by this section, provided, that temporary users, including other branches or agencies of the municipality, or other political subdivisions, shall pay such rates as the governing body shall in each instance fix by resolution. It shall be the duty of the Village Clerk to keep, or cause to be kept, a separate, detailed, and accurate account of all water rents and charges received and due from each consumer in such bookkeeping method the governing body may prescribe.
   (B)   Except as otherwise specifically provided, the following is hereby established as a tariff of water rates to consumers from the Municipal Water Department based on a monthly consumption.
      (1)   Consumers residing inside corporate limits:
         (a)   Minimum bill of $39; and
         (b)   All gallons used or consumed in any month, $2.25 per 1,000 gallons; prorated to the actual amount of water consumed.
      (2)   Consumers residing outside corporate limits:
         (a)   Minimum bill of $49; and
         (b)   All gallons used or consumed in any month, $2.25 per 1,000 gallons; prorated to the actual amount of water consumed.
   (C)   Provided, however, that in no event shall the minimum monthly rate be less than $39 per month for each tap through which water is furnished to consumers residing inside the corporate limits, and $49 per month for each tap through which water is furnished to consumers residing outside the corporate limits. In the event the service is discontinued after notice to the Utilities Superintendent, the consumer shall pay the amount of the minimum monthly charge.
