§ 50.24 PRE-COLLECTION PRACTICES.
   (A)   General. It shall be the duty of every owner or person in possession, charge or control of any dwelling or place of business where garbage, rubbish and household rubbish are produced and accumulated, and of every resident, householder, tenant and person occupying a dwelling, apartment or place of business within the city:
      (1)   To provide and at all times to keep, as in this subchapter prescribed, on his or her premises a sufficient number of containers to hold all garbage and rubbish which may accumulate on the premises of said person during the intervals herein prescribed between the collection of the same by the contractor;
      (2)   To keep and maintain all receptacles for the storage of garbage and rubbish in good and sanitary condition and to replace any such receptacles which may have ragged or sharp edges, holes or other defects;
      (3)   To deposit all garbage and rubbish which may be produced or accumulated daily on the premises in a proper receptacle therefor as herein provided;
      (4)   To drain garbage so it is reasonably free of liquids and to wrap garbage that is loose and of such a nature that it may stick to the container, or cause odor or attract maggots;
      (5)   To deposit and store all rubbish in the same containers as garbage, no separation of garbage and rubbish being necessary;
      (6)   To keep all receptacles for the storing of garbage and rubbish securely covered to prevent any of the contents from being scattered about and to prevent the propagation of rats, flies and other insects or vermin;
      (7)   To place all receptacles for the storage of garbage and rubbish and all household rubbish at the curb line, in front of the premises, on the prescribed collection day prior to 6:00 a.m.;
      (8)   Curb line shall be construed to mean the are between the walk and curb, or, if one or both do not exist, curb line shall mean the area outside the traveled street which is in the street right-of-way. On streets with a 30-foot right-of-way, the area five feet outside the right-of-way may be used; and
      (9)   Trimmings and clippings, tree trimmings, hedge clippings and similar materials shall be cut to lengths not to exceed three feet and shall be placed in cans and containers or securely tied in bundles not more than two feet thick before being deposited for collection. Bundles shall not weigh more than 75 pounds.
   (B)   Containers. All receptacles required by this subchapter for the storage of garbage and rubbish shall be provided by the city and/or its designated contractor. The containers shall conform to the following standards and shall be maintained as follows:
      (1)   All such receptacles shall be of substantial construction made of metal or plastic, equipped with tight-fitting lids and strong handles.
      (2)   All receptacles for the storage of garbage and rubbish shall be of standard type of toter and shall have a capacity not exceeding 95 gallons. The city or its designated contractor may elect to offer toters with smaller capacities for individuals that may have difficulty with the 95 gallon toter.
      (3)   Containers shall be furnished by the city or its designated contractor and shall be maintained in a sanitary condition by the occupant.
      (4)   Approved detachable paper or plastic bags designed expressly for garbage or rubbish will be permitted.
   (C)   Containers at curb. In no case, except for missed collections, shall refuse containers be left at the curb line other than on the day of collection, or after 1:00 p.m. on the day proceeding the day of collection.
