§ 35.03 FALSE ALARMS.
   (A)   There is hereby established a $150 service charge for each Fire Department response to a false electronic, alarm service or notifier alarms, except as provided in division (B) below.
   (B)   There shall be no service charge for Fire Department response to the first three false alarms in any calendar year.
   (C)   There shall be no service charge when there has been no Fire Department response to the alarm.
   (D)   The service charge may be waived by the Director of Public Safety in cases where it can be shown the false alarms are attributable to conditions outside the reasonable control of the alarm subscriber or the building owner or their equipment. The service charges shall be assessed against the owner of the property on which the faulty alarm system is located.
   (E)   The service charge(s) shall be collectible by the city, as provided by law, which collection shall include, but not be limited to, the filing of liens against the real estate at which the faulty alarm system is located.
