(A) Whenever for any reason the pavement cannot be replaced immediately, the filled-in excavation shall be maintained by the excavator, so as not to create a hazard or nuisance to vehicles or pedestrians, until the pavement can be replaced.
(B) If any settlement or failure in a restored area occurs within a period of two years from the date of completion of the permanent restoration, the patch shall be replaced by the excavator at his or her expense.
(C) The city may, by agreement with any particular utility, provide that the replacement of the pavement shall be done by the city and the cost thereof charged against or billed to such utility
