§ 93.22 NUISANCE OR HAZARD.
   (A)   The Tree Committee may make recommendations to remove any tree or part thereof in the city that is in an unsafe condition or which by reason of its nature is injurious to humans, sewers, electric power lines, gas lines, water lines or other public improvements; is affected with any injurious fungus, insect or other pest; or which has been declared a public nuisance.
   (B)   The following may be declared public nuisances under this subchapter:
      (1)   Any otherwise healthy tree, shrub or other plant, whether located on city-owned property or on private property which dangerously obstructs the view in the visibility triangle at the street intersections;
      (2)   Any tree or shrub which obstructs the free passage of pedestrian (10 feet measured from sidewalk surface) or vehicular traffic or which obstructs a street light or traffic-control device;
      (3)   Any tree or shrub on public property that is dead or near dead and constitutes a public safety hazard;
      (4)   The tree interferes with overhead lines and creates a public safety hazard;
      (5)   Those parts of trees standing on private property, overhanging the street right-of-way or other public areas.
