Any variances or special exceptions to this title shall be granted only by the appeal authority under the provisions of chapter 5 of this title prior to the issuance of any master planned development, or other approval by the planning commission. All action on an application shall be stayed upon learning that a variance or special exception is required, until the applicant shall have obtained the variance or special exception, or his request is denied by the appeal authority. Appeals from final action of the appeal authority shall be made to the district court as provided by state law and not to the town council. (Ord., 1-18-2005; amd. Ord. 20-02, 3-17-2020)
