A. Alcohol Consumption Unlawful: It shall be unlawful to consume any alcoholic beverage(s) or have possession of an open container of any alcoholic beverage:
1. On any public street, sidewalk, or other public way.
2. While on private property open for public use without the express permission of the owner, his/her agent, or any person in lawful possession thereof.
3. Upon the grounds of any public park unless a special (written) use permit has been obtained from the Chief of Police.
B. Penalty For Violation: Any person violating any of the provisions of subsection A of this Section shall be guilty of an infraction and shall be punishable as set forth in section 36900 of the Government Code. Every violation determined to be an infraction is punishable pursuant to the provisions of Section 1-4-1 of this Code. A person shall be deemed guilty of a separate offense for each day during any portion of which a violation of this Section is committed, continued or permitted by the person and shall be punishable as herein provided.
