170.09 FINAL PLAT – REVIEW AND APPROVAL.
1.   Final plats and additional required information and documents must be filed by noon of the first working day of the month. The Clerk shall, within five (5) days of filing, submit one copy of the plat and construction plans to the Water Department, Waste Water Department and Fire Department. The Clerk shall submit a copy of the plat, construction plans and documents to the City Engineer and a copy of the plat to the Building Official, the City Administrator, the Parks Superintendent, Street Superintendent and the Recreation Director. The City Engineer and Building Official shall, within fifteen (15) days of filing, report in writing results of the City staff’s review and recommendations to the Clerk, who shall promptly supply copies to the applicant, owner of the land if different, and developer’s engineer. On the last Council meeting of the month the Council will refer the plat for review by the Planning and Zoning Commission at their following month’s meeting if there are less than three (3) significant comments from the City staff. If there are more than three (3) significant comments, the developer will have to submit a revised plat by noon on the Thursday before the last regular Council meeting of the month before the Clerk will put it on the agenda for referral to the Commission. On the referral date, a copy of the final plat comments shall be forwarded to the Commission. A copy of the plat will be available in their City Hall file for review. The Clerk shall promptly notify the applicant, the applicant’s attorney and developer’s engineer of the referral date and the time and place of the Commission meeting and submit final staff comments for their review.
2.   The Planning and Zoning Commission will review the final plat at their next regular meeting after referral. The Commission shall study reports and supplements. The Commission shall notify the Council of their approval, approval with modifications or disapproval of the final plat within thirty (30) days after referral. The City Engineer shall supply copies of the staff’s comments and the Commission meeting minutes to the applicant, the applicant’s attorney, developer’s engineer, Council, Mayor and City staff. Failure of the Commission to act within thirty (30) days after referral shall be deemed to be approval, provided, however, that the applicant and the Commission may mutually agree to an extension of time.
3.   Prior to the Council consideration of the final plat, the City Engineer shall submit a certified report stating that either the public improvements have been constructed under the City Engineer’s supervision and in accordance with the approved plans and specifications or a surety bond or an escrow agreement on City approved form shall be filed.
4.   The Council shall, within fifteen (15) days after receipt of the Commission’s report, approve or reject the final plat.
