165.56 EFFECT OF APPEAL.
An appeal stays all proceedings in furtherance of the action appealed from, including, without limitation of the foregoing, a permittee’s right to proceed with development or other activities authorized under a zoning permit, the issuance of which is subject of the appeal, unless the Zoning Administrator certifies to the Board of Adjustment after notice of the appeal shall have been filed with the Zoning Administrator that by reasons of facts stated in the certificate, a stay would in their opinion, cause imminent peril to life or property. In such case, proceedings or development shall not be stayed otherwise than by a restraining order, which may be granted by the Board of Adjustment or by a court of record on application, on notice to the City Clerk for due cause shown.
