165.32 I-3 GENERAL INDUSTRIAL DISTRICT.
The I-3 General Industrial District is a general purpose industrial and business area for the location of activities and enterprises that might be otherwise objectionable in other areas of the community and by the nature of their activity may result in some negative impacts upon their environment. The purpose of this district is to provide for such uses in the community and to properly insure their negative impacts are properly mitigated.
1.   Location Criteria. The I-3 General Industrial District is appropriately located in isolated locations away from other uses and upon lands that are level and not generally susceptible to environmental degradation. It should be located adjacent to primary arterials and railroads. Such district should be properly buffered from all residential and commercial districts. Such districts shall generally be located such that prevailing winds shall not impact residential areas.
2.   Permitted Uses. The following uses are allowed in the I-3 General Industrial District.
   A.   Waste water treatment plants.
   B.   Consumer Fireworks Sales.

3.   Provisional Uses. The following uses may be allowed in the I-3 General Industrial District upon approval of a provisional use permit by the City Zoning Administrator as required by Section 165.49.
   A.   Food processing, manufacturing and packaging facilities provided sufficient public sanitary sewer and water facilities are available, and no odors are emitted from the facility.
   B.   Grain storage, processing and distribution facilities provided a site plan is submitted in compliance with Section 165.52.
4.   Conditional Uses. The following uses may be allowed in the I-3 General Industrial District upon approval of a conditional use permit by the Board of Adjustment as required by Section 165.50.
   A.   Manufacturing of products and merchandise involving the use of chemicals, processes or materials that might constitute a potential explosive or environmental hazard provided a plan is submitted providing sufficient evidence that proper precautions have been taken to minimize such hazards including ongoing review and monitoring.
   B.   Quarrying and mining operations provided a site plan is submitted in compliance with Section 165.52, precautions are taken to control dust beyond the property limits, provision is made for noise control, provisions are made for compensation to adjoining and area properties if damaged by blasting or other such activities and a plan for reclamation is filed including appropriate provisions for bonds to fund reclamation, as required by the City.
   C.   Slaughter plants, packing houses, animal by-products rendering or other such animal processing activities provided adequate provisions are made to minimize odors, dust, noise and other impacts, and a site plan is submitted in compliance with Section 165.52.
   D.   Sexual activity establishment, massage establishment, adult bookstore, adult cabaret, adult motion picture theater or other similar forms of adult entertainment provided a site plan is submitted in compliance with Section 165.52, and one non-lighted sign no larger than four square feet is proposed.
   E.   Any other industrial use not expressly permitted in this chapter and determined by the Planning and Zoning Commission to have been properly mitigated to protect the public health, safety and general welfare.
5.   Special Exception Uses. The following uses may be permitted in the I-3 General Industrial District upon approval of a special exception permit by the Board of Adjustment as required by Section 165.51.
   A.   Automobile salvage and reclamation yards and facilities provided a site plan is submitted to the City Zoning Administrator in compliance with Section 165.52 and provisions are made to screen the facility entirely from the view of streets and other properties.
6.   Size Regulations. The following minimum and maximum size regulations shall apply in the I-3 General Industrial District:
   A.   Minimum Lot Size: 250,000 square feet
   B.   Building Setbacks: 24  
      Front Yard   50 feet
      Side Yard   50 feet
      Rear Yard   50 feet
   C.   Minimum Lot Dimensions:
      Lot Frontage      250 feet
      Lot Depth       250 feet
      Lot Width       250 feet
      Width to Depth    1:4 minimum ratio
7.   Maximum Building Dimensions:
      Height          100 feet
      Coverage       10%
      Floor Area Ratio    .25
8.   General Provisions. The following provisions shall apply for all uses in the I-3 General Industrial District:
   A.   Parking and loading requirements – See Section 165.35.
   B.   Accessory use and building regulations – See Section 165.12.
   C.   Sign regulations – See Section 165.36.
9.   Special Provisions. The following special provisions shall apply for all uses in the I-3 General Industrial District:
   A.   Transitional yards shall be provided where the rear or side lot line coincides with a side or rear lot line of all non-industrial districts. For residential districts the setback shall be 150 feet and shall be fully landscaped and screened. For all other districts the setback shall be 100 feet and shall be fully landscaped.
   B.   If the Zoning Administrator determines any proposed use in this district may constitute an environmental hazard or present unmitigated environmental impacts the Zoning Administrator shall defer any permit requests until a report and recommendation has been made to the City Council regarding the proposed use and the Council has acted upon the Administrator’s recommendation. After receipt of the Zoning Administrator’s report and a public hearing the Council may set a bonding requirement in favor of the City to adequately protect against potential environmental impacts. In no case shall the City defer a permit request under this provision for longer than 180 days.
