No person, other than the City, shall excavate any ditch, tunnel or trench or lay any drive within a radius of ten (10) feet from any public tree or shrub without first obtaining a written permit from the Forester. Trees, shrubs or plants near any excavation or construction of any building or structure shall be adequately protected and all building material, dirt or other debris shall be kept at least three (3) feet from such trees, shrubs or plants. If loss occurs reimbursement shall be made to the City as determined by the Forester.
