150.05 PERMIT FOR PLANTING.
No person shall plant any tree or shrub in any park, street or other public property in the City without first filing an application and procuring a permit to do so from the Forester. The City Forester, upon receiving such application shall inspect the proposed planting site and determine the exact location, if any, for the tree or shrub to be planted. It is the responsibility of the person applying for such permit to locate all buried utilities. If the proposed planting is desirable and if the planting complies with the provisions of this chapter and the arboricultural specifications and standards of practice set out in Chapter 151, the Forester shall issue the permit upon payment of a fifteen dollar ($15.00) permit fee. The person receiving the permit and any tree surgeon, forester, arboriculturist or worker performing thereunder shall strictly abide by such specifications and standards, unless exceptions thereto are set forth in writing on the permit. The permit shall contain a definite expiration date and may be declared void if its terms are violated. In the event any tree or shrub is planted in conflict with the provisions of this section, the Forester may declare said tree a nuisance or hazard and direct its immediate removal.
